Refound Terms and Conditions
Welcome to Refound (“we,” “us,” or “our”). By accessing or using our platform, including our website, mobile application, and any related services (collectively, the “Platform”), you agree to be bound by these Terms and Conditions (“Terms”). Please read them carefully before using the Platform. If you do not agree with these Terms, you must not use the Platform.
These Terms are governed by the laws of Australia. Your use of the Platform may also be subject to the Australian Consumer Law. Important Note on Consumer Rights: Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law, including consumer guarantees that services will be provided with due care and skill and fit for their stated purpose, or that goods will be of acceptable quality.
1. Acceptance of Terms
By creating an account or using the Platform, you confirm that:
- You are at least 18 years old or have the consent of a parent or guardian.
- You accept these Terms in full.
We may update these Terms at any time. Changes will be posted on this page with an updated effective date and material changes will be notified via the Platform or email. Your continued use of the Platform after such changes constitutes acceptance of the revised Terms.
2. Services Provided
Refound offers a platform that enables users to:
- Register and download free QR codes to attach to personal items.
- Report lost and found items linked to Refound QR codes.
- Purchase QR code stickers.
- Facilitate communication between finders and owners of lost items by sharing the finder’s contact details with the item owner (registered on Refound). Payment of a fee may be required by the owner.
Key Disclaimer: Refound does not guarantee the return of lost items. Our role is limited to sharing the finder’s contact details with the item owner. Recovery arrangements are solely between the owner and finder.
3. User Accounts
- Registration: To use the Platform, you must create an account by providing accurate and complete information, such as your name, email address, and/or contact number. You are responsible for keeping your account credentials confidential and for all activities conducted through your account.
- Account Security: You must notify us immediately if you suspect unauthorized access to your account. Refound is not liable for any loss or damage resulting from your failure to safeguard your account details.
- Account Termination: We may suspend or terminate your account without notice if you breach these Terms or if your actions harm the Platform or other users.
- Communication Preferences: Users can opt out of non-essential communications (e.g., marketing emails) via account settings, but transactional notifications (e.g., item found notifications) are mandatory.
4. QR Codes
- QR Code Usage: You can generate and download QR codes via the Platform to attach to your personal items. You are responsible for properly affixing and maintaining these QR codes. Refound’s QR codes must only be used by the person who has registered a profile on Refound.
- QR Code Stickers: You may purchase QR code stickers directly from Refound or print your own. Refound is not responsible for issues arising from self-printed QR codes.
5. Reporting and Recovering Lost Items
- Reporting Found Items: If you find an item with a Refound QR code, you can report it through the Platform by providing your contact details on an online form. By submitting this form, you agree to share your contact details with the person who lost the item and agree to be contacted directly by that person.
- Facilitating Contact: When a lost and found item is reported, Refound will notify the item owner via email. The owner may pay a fee to access finder details. The fee is non-refundable except where required by the Australian Consumer Law.
- Owner’s Responsibility: The owner must contact the finder directly to arrange recovery. Refound does not facilitate or guarantee the return of the item.
- Finder’s Responsibility: Finders are responsible for providing accurate and up-to-date contact details. Refound does not verify the accuracy of this information and is not liable if the finder provides incorrect or outdated contact details.
- Time Limits for Reporting Found Items: Finders must report items within a reasonable timeframe (e.g., 30 days) of finding them. Refound is not responsible for delays in reporting or recovery.
- Verification: Owners should verify the finder’s identity before arranging recovery to avoid potential fraud or disputes.
6. Privacy and Data Protection
- Collection of Information: We collect and handle personal information in accordance with the Privacy Act 1988 (Cth) and Australian Privacy Principles.
- We collect personal information, including your name, email address, contact number, and item details, to operate the Platform. Payment information is securely processed by a third-party provider and is not stored by Refound.
- Use of Information: Your data is used to manage your account, facilitate communication between finders and owners, process payments, and enhance our services. We do not sell your personal information to third parties.
- Data Security: We take reasonable steps to secure your data, but no system is entirely immune to breaches. We cannot guarantee absolute security.
- You may request access to, correction of, or deletion of your personal information.
- You can delete your profile at any time from within the platform.
7. Fees and Payments
- Free Registration: Registering an account and using basic features of the Platform is free.
- Sticker Purchase Fee:
- A fee is required when a user wishes to purchase QR code stickers through the Refound platform. This fee is payable via the Platform.
- Once payment is made, the fee is non-refundable, except where required by the Australian Consumer Law.
- Change-of-mind refunds are not provided. Refunds will be provided only where required by the Australian Consumer Law.
- Proceed with payment only if ready, as transactions are final subject to Australian Consumer Law rights.
Payment Processing:

- Payments are processed securely via a third-party payment provider. Refound does not store your payment details.
- Once the payment is successfully processed, the transaction is final.
- No cancellations or reversals are permitted except where required by the Australian Consumer Law.
8. User Conduct and Responsibilities
- Accurate Information: You must provide truthful and current information when using the Platform, including when reporting found items.
- Finders specifically agree to provide valid and accurate contact details (e.g., a working email or phone number) when reporting a found item.
- Prohibited Actions: You may not use the Platform for illegal purposes, to harass or impersonate others, or to disrupt its functionality. Specifically, you must not:
- Use the Platform to commit fraud, such as falsely claiming ownership of an item or misrepresenting yourself as a finder.
- Submit false or misleading information about lost or found items.
- Attempt to bypass payment or access restrictions.
- Use the platform for commercial activities.
- Prohibited Items: You may not register QR codes for illegal items (e.g., stolen goods, weapons, or contraband). Refound reserves the right to remove such registrations and terminate related accounts.
- Indemnification: You agree to indemnify Refound against any claims, damages, or losses resulting from your use of the Platform, including but not limited to inaccurate information provided by you or disputes arising from the recovery process.
9. Intellectual Property
- Ownership: All content on the Platform, including QR codes, logos, and text, belongs to Refound or its licensors and is protected by copyright and trademark laws.
- License: You are granted a limited, non-exclusive license to use the Platform for personal, non-commercial purposes. You may not copy, distribute, or modify our content without permission.
10. Third-Party Services
- Integration: Refound may integrate with third-party services, such as payment processors or mapping tools, to enhance functionality.
- Limited Liability: Refound is not responsible for the performance, availability, or security of third-party services. Your use of these services is at your own risk, and you must comply with their respective terms.
11. Updates to the Platform
- Modifications: Refound reserves the right to update, modify, or discontinue the Platform or any of its features at any time, with or without notice.
- Impact on Users: We will make reasonable efforts to notify users of significant changes, but we are not liable for any inconvenience or loss resulting from such updates or discontinuations.
12. Age Restrictions
- Eligibility: The Platform is intended for users who are at least 18 years old. If you are under 18, you must have the consent of a parent or guardian to use the Platform.
- Not for Children: Refound is not designed for or targeted at children under 13. We do not knowingly collect personal information from children under 13.
13. Geographic Restrictions
- Availability: While Refound is accessible globally, certain features or services may not be available in all regions or countries due to legal or operational constraints.
- Compliance: You are responsible for ensuring that your use of the Platform complies with local laws in your jurisdiction.
14. Feedback and Suggestions
- Ownership: Any feedback, suggestions, or ideas you provide to Refound become our property. We may use them without compensation or attribution to you.
- No Obligation: Refound is not obligated to act on or acknowledge any feedback or suggestions.
15. Dispute Resolution Between Users
- User Disputes: Refound is not responsible for resolving disputes between finders and owners, including but not limited to disagreements over item recovery, contact details, or fraudulent activity.
- Ownership Disputes: If multiple parties claim ownership of the same item, Refound will provide the finder’s contact details to the registered owner only. Ownership disputes must be resolved between users and Refound does not assist with this.
- Mediation: We are not mediators and do not take sides in disputes.
- Legal Action: Users must resolve disputes directly with each other. Refound is not liable for any outcomes or legal actions arising from such disputes.
16. Force Majeure
- Unforeseen Events: Refound is not liable for any failure or delay in performing its obligations under these Terms due to events beyond our reasonable control, including but not limited to natural disasters, pandemics, cyber-attacks, or government actions.
17. Limitation of Liability
To the maximum extent permitted by law (including the Australian Consumer Law):
- No Guarantee: Refound does not guarantee the return of lost items, the accuracy of user-provided information (including finder contact details), or the successful recovery of any item.
- As-Is Service: The Platform is provided “as is” without any warranties, express or implied.
- We are not liable for indirect/consequential losses.
- Liability Cap: Total liability capped at fees paid by you in prior 12 months, except where Australian Consumer Law prohibits.
- No liability for user-provided inaccurate details or failed recoveries.
18. Consumer-Specific Terms
- Your Australian Consumer Law rights are not affected. Contact us for Australian Consumer Law related issues.
19. Termination
- By You: You may delete your account at any time from within the platform.
- By Refound: We may terminate or suspend your account if you violate these Terms or if we discontinue the Platform.
- Survival: Provisions related to intellectual property, indemnification, limitation of liability, and dispute resolution will survive termination of your account or these Terms.
20. Governing Law:
- These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the non-exclusive jurisdiction of the courts of New South Wales.
21. Miscellaneous
- Entire Agreement: These Terms represent the full agreement between you and Refound.
- Severability: If any part of these Terms is unenforceable, the remaining provisions will still apply.
- No Waiver: Our failure to enforce any right does not waive that right.
